Sick Leave

Hi people ask ko lang po, if nag sick leave ako with MC after public holiday, considered ba yun as unpaid leave? or should be under sick/annual leave?

  • @Vincent salamat sa sagot, nagulat lang ako kasi nag sick leave ako after public holiday then lumabas sa payslip na unpaid leave yun, ok lang sana kung binawas nln sa annual leave pero hindi. pano kaya diskarte dito
  • yung salary mo base on monthly pay diba hindi daily? if nag MC ka before or after holiday considered parin MC with pay ka (make sure you are a confirmed staff - 3 mos + working in the company - mom rule 14days medical leave). make sure meron ka medical cert to prove.
  • @Samantha1 yes po monthly and confirmed staff ndn po ako dito, sabi nila may rule daw na ganun na after ph, SL is considered unpaid leave. wth! dko lang alam pano makukuha yun hmm
  • tawag ka sa MOM ask mo kung may ganung rule :)
    or kung nakalagay sa contract mo wala kang laban..

  • kung company policy kahit dalhin mo sa MOM wala na yan, charge it to experience na lang.

    thank sa sagot mam & sir, actually sick talaga natiming lang na after public holiday napaMC kasi masama parin pakiramdam, check ko nln muna sa HR and sa contract. baka rule ln ng company ndi ng MOM
  • definitely not MOM rule, kasi may mga companies na allowed naman yan, pero may company talaga na nasa rule nila na unpaid leave ang SL after PH, for the obvious reasons.

    Check with your HR first, if they say na rule yan then no point na sumugod sa MOM
  • hmm i dont know about that, but if like @tambay7 said, pag company Rule. no point. Nakapanig ang MOM sa Employers (kadalasan).
  • @jaegu They should have payed u. The MC alone is a big validation. btw, how many SL days u took?

    hindi po gagawa ng ganyan rule ang MOM, ano yan bawal magkasakit after public holiday, baka po pwedi paki tanong mo nrin sa company mo kung bawal din mag MC before public holiday..
  • @jaegu e search mo online sa mom website at isampal sa HR mo XD, hindi nag reply baka feeling nila ma outsmart ka nila, hay some employers talaga oh. meron ka contract? basahin mo dun if may rule sila.
  • simple lang yan, if determine ka to push with the complaint, make sure na wala nga sa company policy or employment contract mo yan, definitely wala sa MOM, at kung determined ka talaga expect mo din possible consequences sa relationship niyo as employer-employee, check mo kung kelan ang pass renewal mo, manalo ka man sa reklamo di ka nila pwede terminate pero walang makakapigil sa kanila na hindi ka i-renew.

  • @jaegu natakot.. haha kasi ung email nila pwede mong gawing ebidensya laban sa kanila. :)
  • Rule of thumb. tansahin nyo kung tagilid ba kayo pag magrereklamo kayo kayo kasi hindi magiging maganda kung makakaaway ang employer. check ninyo maigi ang contract, dahil madalas naman e nakasaad dun ang mga rules na yan :)
