Non-compete clause in employment contract

May nakaexperience na ba nito? My friend's employment contract has a non-compete clause na nagrerestrict sa kanya magwork or maengage sa competitors ng company within 1yr after termination of employment. Ung company nya, last project na nila un ngayon, at patapos na. Nagcocost cutting din sila kasi wala na makuhang projects, so kesa antayin na di na sya ma-renew, nagaapply na sya sa iba. Nagsialisan na din mga ksama nya-tatlo sila, same company nilipatan-competitor pero bigger company ito, ung current company nila maliit lang. So now, nagkaron din sya ng job offer dun sa bigger company. Kaya lang, biglang nagsend ng warning ang current company nila dun sa tatlong umalis, and sa lahat ng empleyado, reminding them of the non-compete clause sa contract. Hindi naman mataas position ng friend ko, hamak lang din syang empleyado, pero ung 2 sa naunang umalis, sila ung may mataas na position and nakikipagdeal sa clients tlga. Seryoso kaya maging epekto nito sa friend ko if i-accept ung job offer?

    Depende na yan kung gaano ka determined yung current company to pursue yung friend mo. Kung nakapirma talaga sya sa contract eh binding na agreement yun, nasa determination na ng company kung hahabulin talaga nila, usually kung may in house legal dept ung company maghahabol yan, pero kung wala di na kasi kukuha pa sila abogado at submit ng case, gastos lang.

    Sa amin din meron ganyan kaso ang maganda lang sa company namin di strictly pinapatupad, may mga nakaka lipat sa competitor at clients. Di na rin hinahabol ng company, kasi time consuming din yun at gastos dahil need ng abogado ek ek.
  • @maya depends upon the contract..kung wala naman, they can transfer anytime as long as they have 1month notice.
  • @maya - kung ako nasa sitwasyon ng kaibigan mo, i will do the same. hahanap nko ng malilipatan kung gut feeling ko is pabagsak na talaga yung company & there's no way na ma-rerenew ako. Priority ko nun is to survive.
  • First, check the contract! if wala sa pinirmahan, malamang walang effect yan.
    Second, it all depends with the company nga. totoo yun. yung iba, serious sa ganyan. Kasi come to think of it, sila nag-invest sa employees. Tapos kukunin ng competitor. Kaya may ganyan na clause.
  • Nasa contract niya tlga. Pero naging aware lang siya nung nagsend ng warning ung current company. Actually, di naman masyadong takot ung boss sa lilipatan nya, tntawanan lang nila. Nagconsult na sa lawyer and sabi kung magsusue ung current company, marami kailangan patunayan, like ano ba pnprotektahan nila at gaano kadetrimental sa company ung paglipat nya sa competitor. Eh sa totoo lang, hindi naman kataasan ung position ng friend ko, low level employee lang. Sabi din against public policy daw un, kasi parang nirerestrict ung survival ng tao. And masyadong wide din ung clause at mahaba ung 1yr. Anyway, inofferan na sya ng work from home pampacool down ng situation. Uwi muna sya pinas at dun magwork, tas sg salary pa rin. Pag humupa situation saka daw iaapply pass nya.
