Non-compete clause in employment contract
May nakaexperience na ba nito? My friend's employment contract has a non-compete clause na nagrerestrict sa kanya magwork or maengage sa competitors ng company within 1yr after termination of employment. Ung company nya, last project na nila un ngayon, at patapos na. Nagcocost cutting din sila kasi wala na makuhang projects, so kesa antayin na di na sya ma-renew, nagaapply na sya sa iba. Nagsialisan na din mga ksama nya-tatlo sila, same company nilipatan-competitor pero bigger company ito, ung current company nila maliit lang. So now, nagkaron din sya ng job offer dun sa bigger company. Kaya lang, biglang nagsend ng warning ang current company nila dun sa tatlong umalis, and sa lahat ng empleyado, reminding them of the non-compete clause sa contract. Hindi naman mataas position ng friend ko, hamak lang din syang empleyado, pero ung 2 sa naunang umalis, sila ung may mataas na position and nakikipagdeal sa clients tlga. Seryoso kaya maging epekto nito sa friend ko if i-accept ung job offer?

Sa amin din meron ganyan kaso ang maganda lang sa company namin di strictly pinapatupad, may mga nakaka lipat sa competitor at clients. Di na rin hinahabol ng company, kasi time consuming din yun at gastos dahil need ng abogado ek ek.
Second, it all depends with the company nga. totoo yun. yung iba, serious sa ganyan. Kasi come to think of it, sila nag-invest sa employees. Tapos kukunin ng competitor. Kaya may ganyan na clause.
