Si ex-company ay naghahabol at nagsampa ng kaso sa friend ko ng breach of contract.

aside from this, inaaccuse din na nagdisclose daw ng confidential info kaya nakasulot ng clients sa nilipitang company na competitor, kaya nagincur daw sila ng loss. and gusto magclaim ng damages. hello? ung friend ko ay junior level lang and never dealt with any clients. tagadrawing at design lang job scope nya.

nagconsult na din sa lawyer, and sabi ng lawyer ay basura ung kaso. 1st, di raw enforceable ang non-compete clause lalo na sa situation ng friend ko. 2nd, kailngan ni ex-company ng sobrang tinding ebidensya para patunayan na may dinisclose nga ung friend ko. which confident nmn sya na wala dahil wala naman tlga. actually alam naman nung ex-company un, sabi pa ng lawyer mrami daw ganun, parang ang aim lang ay manggulo ng buhay at willing sila gumastos para manggulo at maghabol. so ang problema ng friend ko, napakamahal ng lawyer fees, like around 50k sgd. walang ganun ung friend ko. pwede kaya lumapit sa phil embassy for legal assistance?

  • I'm sure nangba-bluff lang yang si company to intimidate your friend. Wag muna sya kumuha ng lawyer, hintayin nya subpoena or summon, then tsaka sya mag consult formally sa lawyer or seek our embassy. Sa corporate world, plaging pinapanigan ang employee kesa employer, and it will do more harm sa company rather sa friend mo. I highly doubt na tutuluyan sya nyan. I have experience, sa Pinas nga lang, na non-compete clause, and since yung line of work ko is medyo rare, onti lang ang pwede kong pasukan na work, high chance is competitor talaga namin, which eventually dun ako nakapag work. Nag message HR and tumawag pa na pag hnd ako nag resign, magsasampa daw kaso. Pero, bluff lang lahat, dahil mas damaging sa company pag nasangkot sila sa mga kaso na anti-employee. Bka wala na gustong mag work sa kanila if ma highlight ung kaso nila sa former employee nila. With that, I advise na sit tight and wait for the move ng company. And to answer your question, if nakatanggap na si friend ng summon galing sa ex-company, then that's the time na pumunta sya sa embassy to seek legal help. All the best sa friend mo @maya
  • may summon na ung ung ibang ksama nyang nagresign at lumipat sa competitor. andun name nya, pero wala pa sineserve sknya.
  • Pag meron na sya summon, pwede na sya humingi tulong kay Embassy, since welfare na nya ang nakasalalay. Kaya andyan ang OWWA to assist us pag meron mga ganitong aberya pag tayo ay nasa ibang bansa.

    @maya technicalities lang ang usapan jan: non-clause duration period. kung nasa kontrata ay 6 months tas naaprub work pass nya within 6-months ayun yare dun pede i-establish ang evidence. Yung plaintiff can always exaggerate things like revenue and client loss etc. Parang moral damages na pinapagrabe kahit hindi naman pero since proven na me violation sa contract, ayun things and damages' claim can be exaggerated.

    Sa korte kasi, minsan hindi napapanigan ang katotohanan kung mas matimbang ang ebidensha ng kabila. Like what they say, "it's not what you know, it's what you can prove in court"

    nagresearch naman sya before lumipat, so kampante namang walang saysay yung kaso. dami din nabasang other cases na ganito and most of the time, not enforceable dahil against public law. problema lang tlga ung kailangan pa ng lawyer, and gastos, hassle at stress na dulot nito.
  • Bluff lang yan. Magtiwala ka. Hehe. Bihira nga sa SG ang maghabol since melting pot eto ng competition eh. And the fact na wala naman talaga sya sinulot na client. Humahanap lang siguro ng dahilan yung Sales ng ex-company kung bakit hindi na hit yung target nila. Wag sya kumuha ng lawyer, rekta sa embassy pag napadalhan ng summon.

    galing embassy knna. wala naman sila maitulong. magsubmit daw ung friend ko ng 3 quotations ng lawyers dito, at try kung ano ipapaapprove sa pinas. kumbaga eh financial assistance lang maitutulong, subject for approval pa. @RDG magdilang anghel ka sana na bluff lang at magback out na sila. haha kase may pre-trial hearing date na.
  • oh ok, that's good to hear pa din na willing nman tumulong si embassy, Relaks muna si friend, wala naman mapapala si company kung tuluyan friend mo. Unless, malaking isda talaga ung alleged nasulot nya.
  • @RDG wala naman sulutang nangyari. pano manunulot ung friend ko eh di naman sya nakikipagdeal sa clients. loko lang tlg tong ex-company, kung ano2 binibintang.
