Main Tenant harassing Leaving housemate

Hi tanong ko lang po opinyon nyo. May friend kasi ako, lipat na ng titirhan nya dito sa SG. Kaso yung main tenant, hinaharass sya na kesyo nakalagay daw saa contract nila sa bahay na dapat daw 2-3 months notice, (one month lang binigay ng friend ko). Kaso hinihingi ng friend ko copy ng contract pero wala daw sila (main tenant) copy nito. At since less than 2 months daw notice ng friend ko, di raw nya ibabalik deposit nito at kailangan daw nya magbayad pa ng monthly rent sa last month nya, unless makahanap sya kapalit. Anyways, kahit daw makahanap sya kapalit, di pa rin daw ibabalik deposit kasi nga daw less than 2 months notice nya. Kaso sabi ko, wag sya papayag hanggat wala maipakita na nakalagay sa contract yun. (Which is ngayon lang ako nakarinig ng ganong terms & conditions). At tinatakot pa sya na pede sya isumbong sa MOM. Which is wala naman sya ginagawang mali.

May advice or suggestion po ba kayo kung ano dapat gawin ng friend ko?

  • @singapoorboy base sa personal experience ko, nag complain kami sa small claim, at ang judge magbabase sa kung ano nkikita nya..it means kung ano nkalagay sa kontrata..if walang kontrata pinirmahan yung friend mo wag sya matakot bagkus pwedi sya magreklamo sa small claim, ewan ko lang kung hindi matatakot yang Main tenant na yan pag nkareceived sya sulat mula sa court hehe
  • Thank you @popoy and @jrdnprs ! Yun nga rin sabi ko sa friend ko, wag sya matakot kung tinatakot sya kasi wala naman syang ginagawang mali. Sabi ko pa nga pede sya punta mag report sa plice for Mediation. Pero parang mas okay ung small claims clourt. Sige thanks ulit!
  • @jrdnprs yes filipino main tenant na kupal. Lol. As of now, di daw nagrereply sa request nya na magproduce ng contract. Hehe.
  • ask ko lang po before ka nag stay sa place nila. alam mo ba yung condition nila kapag umalis ka? kasi meron iba is thru verbal or text msg lang at wala ng contract.

    @singapoorboy I too was a main tenant before, headache (if someone leaving) need to look replacement, I understand the MT, but 2-3 months is too much. Unless your friend agreed before, better settle amicably. Talk properly and have respect. Lodging to Authority would be more complex,
  • He should have a copy of the contract too. check and verify his contract. If verbal lang ang arrangement mahirap rin patunayan na nag deposit ka sa kanya at advance. kahit may pumasok sa account nya, pag walang resibo and contract about your occupancy. medyo tagilid makuha ang refund :(
